Court drops initial ruling against Faro

The judge presiding over a lawsuit against Faro Technologies, Lake Mary, Fla., has withdrawn the summary ruling that the company had infringed on a competitor's patent.

Romer CimCore filed a suit claiming that the infinite rotation feature on Faro's Platinum FaroArm's joints infringed on its U.S. patent 5,829,148. The judge accepted Faro's request for reconsideration and agreed that the court had misinterpreted the claims.

The judge is also reconsidering conclusions made from the Markman, a pretrial hearing often used in patent infringement cases. The new Markman and hearing-on-summary judgments of infringement were scheduled for Oct. 3 and Nov. 7.
